An Ordinance to prevent trespasses upon the Defences of the Colony and the Sketching of such Defences.

Bx it enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows

1. This Ordinance may be cited as The Defences Protec- Short title. tion Ordinance, 1897.

"Defence" shall include any battery, fortification, Military or Naval store or factory, armoury, min- ning, electrical, or torpedo establishment, and any position or range finding cell or enclosure. "Guard" shall include any soldier or sentry belong- ing to Her Majesty's regular forces who is employ- ed on duty in any "Defence."

PART I

TRESPASSES.

3. No person shail enter any "Defence" in this Colony, Trespass by unless he is the bearer of a written order for that purpose unauthorised duly granted to him by the Officer in Command of Her persons, Majesty's regular forces in this Colony, or unless he be an Penalty. officer or warrant officer of the Army, Navy or Marine Forces in uniform or a non-commissioned officer or private of the Army, Navy, or Marine Forces on duty, and any person who shall so enter, contrary to this Ordinance, shall be liable, on summary conviction before a Magistrate, to a penalty not exceeding five hundred dollars or to impri- sonment with or without hard labour for any time not exceeding three months:

Provided always, that any order granted to any contractor employed by the Officer Commanding the Royal Engineers or by the Officer Commanding the Army Service Corps, sball cover all Chinese labourers actually employed on work in any

"Defence" and duly provided with proper passes.

4. If any person, not being an officer or warrant officer Arrest for of the Army, Navy, or Marine Forces in uniform or a non- trespass. commissioned officer of the Army, Navy, or Marine Forces such on duty, enters or attempts to enter, or is found in any "Defence," any guard may require such person to show his order for the purpose, and if such person upon being so required does not produce and show his order, or if the said guard suspects that the order produced and shown to him is not an order duly granted to such person, or not sufficient authority for such person to be in the said "Defence," he may arrest such person forthwith and deliver hiro into the charge of a constable or offiear of the Police Force.

5. No person, whether a British subject or an alien, shall Sketching of make any sketch, drawing, photograph, picture, or paint- "Defences," ing, of any "Defence" or any part thereof, within this Colony or the waters thereof, without having previously obtained the permission in writing of the Officer in Com- mand of fler Majesty's regular forces in this Colony. Such permission shall clearly and expressly state the nature of the sketches, drawings, photographs, pictures, or paintings, which may be made by the person to whom such permission is given, and the place or places of which such sketches, drawings, photographs, pictures, or paintings may be made.

6. Any person contravening the provisions of section 5 Penalty. of this Ordinance shall be liable, on summary conviction before a Magistrate, to a penalty not exceeding five hundred dollars or, at the discretion of the Magistrate, to imprison- ment with or without hard labour, for any period not exceeding six calendar months; and all such sketches, drawings, photographs, pictures, and paintings shall, at the discretion of the Magistrate, be liable to forfeiture.
